Digital Millennium Copyright Act (DMCA) Policy

LeafLink is committed to complying with intellectual property laws and expects its users to uphold the same standards. Users transacting on LeafLink’s platform are responsible for ensuring they possess all necessary rights to their posted content and that their postings do not infringe upon or violate the rights of any third party.

In compliance with the Digital Millennium Copyright Act (DMCA), we have established this DMCA Policy to address alleged copyright infringements related to content posted on LeafLink platforms. This policy outlines the procedures for reporting copyright violations and how we handle such reports.

Reporting Copyright Infringement

If you are a copyright owner or authorized to act on behalf of one, you can report alleged copyright infringement on LeafLink platforms by submitting a valid DMCA Notice of Claimed Infringement Form (“DMCA Notice”) to our Copyright Agent via:

Your DMCA Notice must include all of the following information:

1. An electronic or physical signature of the copyright owner or a person authorized to act on their behalf;
2. A description of the copyrighted work that you claim has been infringed;
3. The URL(s) or location(s) on our platform where the infringing material is located;
4. Your full legal name, mailing address, telephone number, and email address;
5. Verify these statements by including, and adding your name to, the following affidavit:
   1. I, <your full name>, wish to state that:
      1. I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; 
      2. This notification is accurate; and
      3. Under penalty of perjury, I am the owner, or an agent authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. 

Please note that a copy of your DMCA Notice, including your contact information, may be provided to the user who posted the content.

LeafLink may request additional information before processing your DMCA Notice, such as a letter of authorization from the rights owner, identity verification of the reporting party, or other documentation regarding the claimed right. LeafLink may reject reports of infringement that contain information we believe to be false, fraudulent, or otherwise submitted in bad faith. 

Submitting a Counter-Notice

If LeafLink removes your content based on a DMCA Notice, and you believe that your content was removed in error, you may submit a counter-notice to our Copyright Agent via the contact information provided above. 

Note that there may be legal consequences if you submit a counter-notice. Please consult your own legal advisor(s) for more information.

Your counter-notice must include all of the following:

1. Your physical or electronic signature;
2. Identification of the material that has been removed, along with the URL(s) or location(s) where it appeared before removal;
3. Your full legal name, mailing address, telephone number, and email address;
4. Verify these statements by including, and adding your name to, the following affidavit:
   1. I, <your full name>, wish to state that:
      1. I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, the judicial district in which LeafLink may be found, and will accept service of process from the claimant. 
      2. I swear, under penalty of perjury, that I have a good faith belief that the material identified in the notification was identified, removed, and/or disabled as a result of mistake or misidentification. 

Please note that a copy of your counter-notice, including your contact information, may be provided to the user who submitted the original DMCA Notice.

Repeat Infringement

If you continue to post infringing material or repost content that has been reported and taken down by LeafLink, you may face additional actions, up to and including account suspension or termination. LeafLink reserves the right to suspend or terminate accounts at its discretion.
